Abstract

One of the most pressing issues today is the development of
administrative legislation in the Republic of Kazakhstan. In recent decades,
precisely the administrative and legal relations and the legal framework have
changed radically. One of them is the adoption of a draft Code of Administrative
Procedure. However, the lack of development of industry theory leads to
theoretical “chaos”. There is a question of the formation of an independent
branch of law - the administrative process. In this regard, the concepts of
“administrative proceedings” and “administrative justice” began to compete
with each other. Some scholars equate them, while others believe that the
concept of “administrative justice” is outdated and is important for the
development of the administrative process.
